Unfortunately for our client, the at-fault driver carried only the state’s minimum liability policy – $25,000 per individual for a bodily injury claim. Given the severity of the accident, it is likely that any competent personal injury attorney could recover the full $25,000 for the client.
Our team was savvy enough to recognize that every liability insurance policy sold in Oklahoma includes an offer of additional coverage called uninsured/underinsured motorist (UM) coverage. If a policyholder elects not to purchase UM coverage, he or she must sign a waiver acknowledging the offer and confirming the rejection. If the insurance company cannot produce this signed waiver after an accident happens, the policy holder is entitled to a default award of an additional $25,000 per individual.
Our client benefitted from this law which is not known to all who claim to practice personal injury. We doubled our client’s gross recovery from $25,000 to $50,000. Why? Because our lawyers know what others do not.
